ศาลรัฐธรรมนูญ จะตัดสินวินิจฉัยว่า การที่นายธนาธร จึงรุ่งเรืองกิจ หัวหน้าพรรคอนาคตใหม่ ปล่อยเงินกู้ ๑๙๑.๒ ล้านบาทให้พรรคตัวเอง จะเป็นการขัดขืนพระราชบัญญัติรัฐธรรมนูญ ว่าด้วยพรรคการเมือง พศ ๒๕๖๐ หรือไม่

ชะตาของ คดีนี้ ขึ้นอยู่กับการวินิจฉัยว่า เงินกู้จำนวนดังกล่าวจะถือเป็น รายได้ ของพรรค อนค หรือไม่
ตามมาตรฐานการทำบัญชี ในทั่วสากลโลก ไม่มีใครเขาจัด เงินกู้ ว่าเป็น รายได้ – มันเป็นหนี้สินกู้ยืม ซึ่งจะต้องจ่ายคืน ดังนั้น หากผู้พิพากษาศาลรัฐธรรมนูญมีความซื่อสัตย์ และ ยุติธรรม จริงๆ ทั้งพรรค อนค และหัวหน้า คงได้รับการตัดสินว่าบริสุทธ์จากข้อกล่าวหาทั้งปวง
แต่ก็เป็นที่รู้กันโดยทั่วไปแล้วว่า ผู้พิพากษา ไม่มีทั้งความยุติธรรม หรือ ความซื่อสัตย์ - ศาลรัฐธรรมนูญ เท่าที่ผ่านมา ได้ให้คำตัดสินบ่อยไป ที่เป็นความขลาดเขลา เข้าข้างพวกเจ้าและเหล่าทหารผู้กุมอำนาจ ในขณะที่ ตัดสินให้บรรดาพรรคการเมืองฝ่ายประชาธิปไตย เป็นฝ่ายโดนรับเคราะห์ไปตามๆกันมาแล้ว
ผู้กุมอำนาจการปกครองของไทย ได้รวมกำลังโหมกระหน่ำโจมตี เพื่อขุดรากถอนโคนพรรคอนาคตใหม่ จากแหล่งข่าวระดับสูงมากหลาย ได้ชี้ว่า เป็นประกาศิตโดยตรงมาจากกษัตริย์วชิราลงกรณ์
ตัวกษัตริย์เอง มีความหวาดระแวงกับพรรคนี้ และหวั่นต่อประกายที่ถูกจุด โดยเฉพาะในหมู่คนรุ่นใหม่วัยเยาว์ ที่จะยืนหยัดเพื่อประชาธิปไตย และ สิทธิมนุษยชน แถมยังวิพากษ์วิจารณ์พวกเจ้าและทหารแบบใม่ยั้งปากในโซเชียลมีเดีย
พรรคอนาคตใหม่ ต้องการสร้างรากฐานทางประชาธิปไตยในประเทศไทย ในขณะที่ วชิราลงกรณ์ ต้องการลากประเทศย้อนยุคถอยหลังกลับสู่วันวานของระบอบสมบูรณาญาสิทธิราช ตัวกษัตริย์ต้องการที่จะบดขยี้พรรคนี้ และจำคุกคุมขังสมาชิกระดับหัวหน้า หรือไม่ก็ขับออกจากวงการการเมืองอย่างถาวร
สมุนคนสนิทของ วชิราลงกรณ์ คือ ผู้นำกองทัพบกผู้คลั่งเจ้า อภิรัชต์ คงสมพงษ์ ที่ตัวกษัตริย์กะจะตั้งให้เป็นนายกฯ เมื่อเขามีคุณสมบัติพร้อมในอีกไม่กี่ปีข้างหน้า ก็เกลียดพรรคอนาคตใหม่ อันเป็นพรรคที่ได้ประกาศเรียกร้องให้ทหารอย่าได้มายุ่งกับการเมือง และต้องการให้ล้มเลิกระบบการเกณฑ์ทหาร
เมื่อเดือนตุลาคมที่แล้ว อภิรัชต์ ออกมาพูดเหมือนคนสติแตกอัดธนาธร กับ พรรค อนค โดยตรง เขาได้อ้างว่า พวกปัญญาชนฝ่ายซ้าย คอมมิวนิสต์ พวกนักการเมืองฉ้อโกง และ ชาวต่างประเทศที่ชั่วร้าย กำลังสมคบส้องสุมกันที่จะทำลายล้างประเทศไทย ด้วยการใช้เทคนิคแบบ “สงครามลูกผสม” โดยอาศัย พร็อพพาแกนด้า (การชวนเชื่อ) การปลุกปั่นปลุกระดม การประท้วง รวมทั้งการให้ข้อมูลบิดเบือนอย่าง ข่าวปลอม เฟคนิวส์
การที่ อภิรัชต์ ยังหลงหมกมุ่นอยู่กับเรื่องผู้ก่อการร้ายคอมมิวนิสต์อยู่อีกนี้ แสดงว่าเขายังติดแหง็กอยู่กับทั้งอดีต และทั้งทฤษฏีเกี่ยวกับผู้ก่อการร้าย เป็นเรื่องน่าสมเพชที่สุด - มันชี้ชัดเลยว่า ในวัง กับผู้ปกครองไทย ยังยึดการใช้โฆษณาชวนเชื่อ การล้างสมอง และข่าวปลอมๆ มาช่วยเกาะยึดกับการครองอำนาจ และการบั่นทอนความเป็นประชาธิปไตย
แต่เมื่อทั้งวชิราลงกรณ์และอภิรัชต์ มุ่งมั่นที่จะทำลายล้างพรรคอนาคตใหม่ พวกอวยเจ้าชั้นสูงก็อ่อนน้อมค้อมหัวรับคำสั่ง ไปปฏิบัติให้ได้ดั่งใจเจ้านาย อนาคตของพรรคนี้ดูจะริบหรี่ไปเสียแล้ว
จึงมีความเป็นไปได้มากว่า ผู้พิพากษาศาลรัฐธรรมนูญจะตัดสินว่า พรรคอนาคตใหม่ละเมิดกฏหมายจริง ถ้าศาลตัดสินว่า เงินกู้นั้น เป็นรายได้ หรือเงินบริจาค คณะกรรมการกลางพรรคทุกคนจะโดนแบนทางการเมืองถึงห้าปี ก็จะเป็นการกุดหัวแกนนำของพรรค และเงินกู้ทั้งหมดก็จะโดนริบ
หากผู้พิพากษายังตัดสินอีกว่า เงินกู้นั้น คือ นิติกรรมอำพราง อันเป็นการฝ่าฝืน มาตรา 72 พระราชบัญญัติประกอบรัฐธรรมนูญ (พ.ร.ป.) ว่าด้วยพรรคการเมือง พ.ศ. ๒๕๖๐ ด้วยแล้ว พรรคอนาคตใหม่ ก็จะโดนยุบไปด้วย
แม้ว่า พรรค อนค จะรอดตัวจากคำตัดสินในวันศุกร์นี้ ฝ่ายปกครองคงจะไม่หยุดมือหาเรื่องบดขยี้พรรคนี้ลงให้ได้ อนค และธนาธรยังมีอีก ๒๘ คดีที่จะต้องฟันฝ่าต่อสู้กันไปอีก
ธนาธร ได้ถูกศาลรัฐธรรมนูญ ตัดสินให้สิ้นสภาพการเป็น สส สมัยปัจจุบันไปแล้ว ด้วยข้อกล่าวหาว่า เขามีหุ้นในบริษัทสื่อมวลชน ทั้งๆที่เขาได้แสดงเอกสารให้เห็นแล้วว่าเขาขายหุ้นเหล่านั้นไปหมดแล้ว ในขณะเดียวกัน มี สส ถึง ๕๕ รายที่อาจจะมีหุ้นในบริษัทสื่อมวลชนที่ยังไม่โดนแม้กระทั่งการระงับไม่ให้เข้าสภา เป็นการโชว์มือว่าเลือกปฏิบัติสองมาตรฐานอันไม่เท่าเทียมกันอย่างไร้ยางอาย
คณะกรรมการเลือกตั้ง (กกต) และศาลรัฐธรรมนุญ ทำตัวแบบเลือกปฏิบัติมาตลอด โดยจะตัดสินลงโทษอย่างไม่เป็นธรรมต่อพรรคการเมืองฝ่ายประชาธิปไตย อย่าง พรรคอนาคตใหม่ เพื่อไทย ไทยรักษาชาติ ที่ถูกยุบไปก่อนที่จะได้ทันลงเลือกตั้งปีที่แล้วเสียอีก
แล้ว กกต ก็ทำไม่รู้ไม่ชี้ กับการหาทุนของ พรรคพลังประชารัฐ ของประยุทธ จันทร์โอชา ที่ตั้งโต๊ะจีนเก็บเงินเข้าพรรคถึง ๖๕๐ ล้านบาท – แถมยังรับบริจาคจากรัฐวิสาหกิจ เช่น ฝ่ายการว่าการกรุงเทพมหานคร การท่องเที่ยวแห่งประเทศไทย ซึ่งขัดกับพระราชบัญญัติว่าด้วยพรรคการเมืองอย่างโจ่งแจ้ง
เหตุที่พรรค อนค ต้องกู้ยืมเงินจาก ธนาธร ก็เพราะ กกต สรรหากฏข้อบังคับมาจำกัดตัดขาพรรคเกิดใหม่ แล้วยกความได้เปรียบใส่พานสนองพรรคพลังประชารัฐ อันขัดกับหลักการที่ต้องให้ความเท่าเทียมกัน
กกต อนุมัติให้จดทะเบียนพรรคอนาคตใหม่ ในวันที่ ๓ ตุลาคม ๒๕๖๑ ซึ่งทางพรรคก็ได้เปิดทำการหาทุนทันที ต่อมาในวันที่ ๑๐ ตุลา กกต ฟันธงมาว่า จะไม่มีการอนุญาตให้พรรครับเงินบริจาค และในวันที่ ๑๔ พฤศจิกายน การหาทุนของพรรคก็ถูกระงับลงอย่างสิ้นเชิง
มันจึงเป็นเรื่องที่เป็นไปไม่ได้ ที่ทาง อนค จะสามารถเตรียมการรับการเลือกตั้ง เพราะถูกตัดทางหาทุนไปหมดสิ้น ธนาธร จึงต้องยื่นมือเข้ามาให้เงินกู้
ทางรัฐบาลรัฐประหาร เพิ่งจะปล่อยอนุญาตให้มีกิจกรรมทางการเมือง ในวันที่ ๑๑ ธค ๒๕๖๑ และพระราชบัญญัติเกี่ยวกับการเลือกตั้ง ก็เพิ่งมาประกาศใช้ในวันที่ ๒๓ มกราคม ๒๕๖๒ แค่สองเดือนก่อนเลือกตั้งทั่วไป พรรคน้องใหม่อย่าง อนค จึงเสียเปรียบเป็นอย่างมาก ในขณะที่ พรรคพลังประชารัฐ วิ่งฉิวออกหน้าก่อนใครไปนานแล้ว
จึงแทบจะเป็นที่แน่ใจได้เลยว่า พรรค อนค จะโดนยุบ ถ้าไม่ในวันศุกร์ที่จะถึงนี้ ก็คงจะเป็นวันใดวันหนึ่งก่อนการเลือกตั้งครั้งหน้า ตัวธนาธรเองอาจต้องติดคุก – ซึ่งเป็นสิ่งที่เขาเก็งเอาไว้แล้ว ก่อนที่จะหาญกล้าลงมาออกแรงแผ้วทางไปสู่สังคมประชาธิปไตยอย่างแท้จริง
แต่สิ่งที่ วชิราลงกรณ์ และอภิรัชต์ ยังตระหนักได้ไม่ถึงก็คือ อนาคตใหม่ ไม่ได้เป็นเพียงแค่ พรรคการเมือง มันเป็นการเคลื่อนไหวทางสังคม ของชาวไทยนับล้านๆ ที่สุดเอียนแสนระอาต่อการคอรัปชั่น รัฐประหาร และลูกเล่นของกษัตริย์ผู้ปกครองประเทศไทย ในขณะที่ตัวเขาเองพำนักอาศัยอยู่ในต่างประเทศอย่างเยอรมนี และ สวิสเซอร์แลนด์ ผลาญเงินภาษีชาวไทยไปอย่างเหลือคณานับ
การบดขยี้ พรรคอนาคตใหม่ จะได้ก็เพียงแต่ต่อยอดความแตกแยกในสังคมไทย ให้ถึงจุดเดือดที่วันหนึ่ง พวกทหารและกษัตริย์จะถูกเขี่ยออกไปจากการเมือง วชิราลงกรณ์ และเหล่าสมุน จะไม่มีวันที่จะฉุดรั้งประเทศไทยให้ติดงั่กอยู่กับอดีตไปได้ตลอดกาล

ANALYSIS—The Constitutional Court will rule on Friday on whether a 191.2 million baht loan to the Future Forward Party from its leader Thanathorn Juangroongruangkit breached the 2017 constitution's organic law on political parties.
The case hinges on whether the loan should be treated as income received by Future Forward.
It is standard accounting practice all over the world that a loan is not regarded as income — it's a debt that must be repaid. So if the Constitution Court judges were fair and honest, the party and its leaders would be cleared of any wrongdoing.
However, the judges are widely known to be neither fair nor honest — the Constitution Court has made rulings that are frequently absurd, and which benefit the monarchy and military at the expense of pro-democracy parties.
The Thai regime has launched a heavy-handed campaign to destroy Future Forward, and according to several high-level sources, this has been directly ordered by King Vajiralongkorn.
The king is paranoid about the party, and the growing tendency especially among younger Thais to stand up for democracy and human rights and openly criticise the military and monarchy, especially on social media.
Future Forward wants to build a democratic Thailand while Vajiralongkorn wants to drag the country back into the past to the days of absolute monarchy. The king wants the party crushed, and its leaders jailed or driven out of politics.
Vajiralongkorn's close ally Apirat Kongsompong, the fanatically royalist army chief who the king plans to instal as prime minister once he is eligible in a few years, also hates Future Forward, which has called for the military to stay out of politics and for conscription to be abolished.
In October, Apirat made a hysterical speech that directly attacked Thanathorn and Future Forward. He claimed that leftist academics, communists, corrupt politicians and evil foreigners were conspiring to destroy Thailand using techniques of "hybrid warfare" such a propaganda, sedition, protests, and misinformation including fake news.
Apirat's obsession with a communist threat showed how stuck in the past he remains, and his conspiracy theory is absurd — clearly it is the palace and the Thai regime that use propaganda, brainwashing and fake news to try to hold on to power and undermine democracy.
But with Vajiralongkorn and Apirat both determined to destroy Future Forward, and the royalist elite obediently obeying their wishes, the party's future looks bleak.
So there is a strong possibility that the judges will declare that Future Forward breached the law. If they rule that the loan was income or a donation, breaching article 66 of the political party law which put a 10 million baht limit on donations, all the party's executive members will be banned from politics for five years, decapitating the Future Forward leadership. The loan funds will be confiscated.
If the judges also rule that the loan was income via an illegal channel, in breach of article 72 of the political party law, then the Future Forward Party will be dissolved.
Even if the party survives Friday's ruling, the regime's attempts to crush it will continue. Future Forward and Thanathorn still face 28 more outstanding cases against them.
Thanathorn has already been disqualified from being an MP in the current parliament by the Constitutional Court for allegedly owning shares in a media company, even though he showed evidence he had sold the shares. Meanwhile, 55 other MPs who may have shares in media companies have not even been suspended from parliament, in a blatant display of double standards.
The Election Commission and Constitutional Court routinely rule against pro-democracy parties like Future Forward, Pheu Thai, and Thai Raksa Chart which was dissolved before it could even compete in last year's election.
The Election Commission took no action against Prayut Chan-ocha's junta party Palang Pracharat over a lavish banquet at which it raised 650 million baht — including donations from state agencies such as the Bangkok Metropolitan Administration and the Tourism Authority of Thailand, which is not allowed under the political party law.
The reason Future Forward needed the loan from Thanathorn in the first place was because of ridiculous rulings by the Election Commission designed to undermine the party and give Palang Pracharat an unfair advantage.
The Commission registered Future Forward as a party on October 3, 2018. On October 6, the party opened for membership and fundraising. But on October 10 the Commission said no donations were allowed, and on November 14 it told the party no fundraising was allowed.
This made it impossible for the party to prepare properly for the elections, because it had been deliberately starved of funds. So Thanathorn stepped in with a loan.
It was only on December 11, 2018, that political activities were allowed by the junta, and the election law was only published on January 23, 2019, just two months before the election. So parties like Future Forward were placed at a huge disadvantage, and Palang Pracharat had a massive head start in the election.
It's almost certain that Future Forward will be dissolved, if not on Friday then sometime before the next election. Thanathorn may end up in jail — something he predicted himself when he launched his brave effort to bring genuine democracy to Thailand.
But what Vajiralongkorn and Apirat don't understand is that Future Forward is not just a party. It's a movement, supported by millions of Thais sick of corruption, coups, and the antics of the king, who rules Thailand from Germany and Switzerland and squanders vast amounts of taxpayers' money.
Destroying Future Forward will further polarise Thailand and eventually the military and monarchy will be kicked out of politics. However hard they try, Vajiralongkorn and his allies can't keep the country stuck in the past
