After Trump's designation: Democrat threatened with court-martial

Democratic senator and retired Navy captain Mark Kelly may be recalled to active duty to face trial in a military court. The Pentagon says this, according to Reuters.

Kelly is one of six Democrats who in a video urged American soldiers to refuse illegal orders. This prompted Donald Trump to call them traitors and threaten them with imprisonment and the death penalty, although he later clarified that he does not want to execute them.

The US Department of Defense is now launching an investigation into Kelly for "serious allegations of misconduct/malfeasance", according to NBC. Of the six military and intelligence veterans, he is the only one who could be subject to military criminal law – if he is called out of retirement, writes Defense

Democrats file police report on Trump – accuse of threats

At least two Democrats have filed police reports against President Donald Trump’s social media posts, Axios and the Washington Post report.

On Thursday, Trump wrote on social media that six Democrats who urged soldiers to refuse illegal orders are traitors and that it is punishable by death.

Now at least two Democrats, Jason Crow and Chris Deluzio, want the Capitol Police to investigate what they call “frightening, threatening and disturbing” posts on social media. Axios writes that it is extremely unusual for members of Congress to file police reports against sitting presidents.

The White House has dismissed allegations that Trump’s posts constituted a threat. The police do not want to comment on the matter.

Judge drops charges against Comey and James

Judge dismisses charges against former FBI Director James Comey and New York State Attorney Letitia James, American media reports.

The reason is that the prosecutor who led the investigations, Lindsey Halligan, has not been properly appointed by the US Department of Justice.

- I am encouraged by today's victory and grateful for the prayers and support I have received from across the country, James said in a statement according to the AP.

Letitia James has been indicted for a case involving suspected mortgage fraud and James Comey has been indicted for perjury.

Donald Trump's administration was clear that a legal process would be expedited against the two, who are both considered political opponents of Trump, according to TT.

The indictment of Comey and James – the case at hand

• Donald Trump publicly called for the indictment of several political opponents, including former FBI Director James Comey and Attorney General Letitia James.
• James Comey was indicted at the end of September for lying to Congress about the Russia investigation, after Trump's newly appointed Attorney General Lindsey Halligan pushed through the indictment despite the advice of experienced colleagues.
• Shortly thereafter, indictments were filed against Letitia James, who previously led the legal process against Trump, and against John Bolton, Trump's former national security adviser and now critic.
• Several legal experts and former prosecutors have criticized the indictments against Comey and James as weakly substantiated and believe that they may be politically motivated.
• All defendants – Comey, James and Bolton – have pleaded not guilty and describe the indictments as an attempt by Trump to use the legal system against his critics.
